The applicant was seeking relief in a form a payment an amount of R439 434.00 for injuries caused by the employee of the respondent. The applicant boarded the train at New Brighton station, Port Elizabeth, at about 1 am the following morning, the ticket examiner wrongfully and unlawfully assaulted the applicant by intentionally pushing, kicking him out of the door of the moving train. The applicant fell from the moving train and was seriously injured. The defendant was ordered to pay the applicant the costs including the cost of photographs.
